A trademark is a ‘characteristic sign’ or ‘indicator’ which is used by a person, business organization, or any other legal body to recognize that the ‘products’ or ’services’ for costumers, which trademark appears from original source, and to differentiate its products or services from those of other products.
Trademark can be selected by the following symbols:
- ™ , used for an ‘Unregistered’ trade mark, an indicator used to endorse or brand product.
- ℠, used for an ‘unregistered’ service mark, an indicator used to endorse or brand services.
- ®, used for a recorded trademark.
A trademark is a kind of rational property, and usually a name, slogan, word, logo, icon, figure, design, or mixture of these fundamentals. There is a variety of ‘non-conservative’ trademarks including marks, which do not fit into these particular categories. The possessor of a registered trademark can begin legal proceeding for ‘violation of trademark’ to protect illegal use of that trademark. Though, registration for trademark is not required. The possessor of familiar law trademark can also file suit, but an unregistered trademark can be secure only within the territory in which it has been used or in the territory in which it may be practically expected to develop.
The word ‘trademark’ is also used unofficially to refer to any distinctive quality, by which a person is readily recognized, like the popular characteristics of celebrities. If a trademark is used in relation to services rather than products, then it may be referred as a service mark, especially in United States.
History of trademark:
In the history of trademarks, it is generally reported that blacksmiths who created swords in the age of Roman Empire, were the first to use trademarks. The other prominent trademarks which have been used in past are ‘Lowenbrau’, which claims the use of trademark, since 1383, and ‘Stella Artois’, who also claims the use of trademark, since 1366.
Recorded trademarks include registering the brands with the government. The oldest listed trademarks in different countries comprise:
- United Kingdom, in the 1876. The first trade name was The ‘Bass Red Triangle’, which was recorded in the ‘Trade Mark Registration Act 1875’.
- United States, Image of Samson fighting a lion, to Samson Cord.

Instructions
- Create a ‘™ icon’ in Microsoft Word. Write the words ‘TM’ into the Word document. Pick the text, right click and select “Font.”
- Go to the “Font” menu of the dialog box. Choose “Small Caps” and after that “Superscript” in the “Effects” section. Hit “OK” to use the changes.
- Pick up the text again and click on the keyboard’s shortcut “Alt+F3.”. After that a “Create AutoText” dialog box will appear on the screen. Form a shortcut for the entrance, for example ™ and click “OK” to put aside the entry. While typing ™ in a Word document, the ™ icon will emerge after pressing “Enter.”
